放眼中国近20年的经济发展史,中国政府对外企一直格外关照。与国内同类私营企业相比,在华经营的外企通常会感受到中国经营环境的宽松和优越。国际投资法上的外资国民待遇是指投资东道国根据其参加的国际多边、双边协定的规定,给予外国投资及投资者以不低于本国投资及投资者的待遇。所谓超国民待遇是指赋予外国投资者超过本国投资者的待遇。显然,从目前中国企业到海外投资的种种反馈看,中国企业在发达国家的遭遇,根本谈不上国民待遇,更无所谓“超国民待遇”。中国企业在国际市场中,不仅遭遇着环保、知识产权等壁垒,甚至面临着被妖魔化、被泛政治化的困局。而放眼国内,外资企业却处处享受着超国民待遇。
Looking at the history of economic development in China for nearly 20 years, the Chinese government has always taken special care of foreign companies. Compared with similar private enterprises in China, foreign companies operating in China usually feel relaxed and superior in China’s business environment. Foreign investment in international investment law National treatment refers to the investment by the host country in accordance with its participation in the international multilateral and bilateral agreements, to foreign investors and investors to not less than domestic investment and investor treatment. The so-called super-national treatment refers to giving foreign investors more treatment than their own investors. Obviously, judging from the current feedback from Chinese enterprises to invest overseas, the experience of Chinese enterprises in the developed countries can not be compared with the national treatment at all, let alone “super-national treatment.” In the international market, Chinese enterprises not only encounter barriers such as environmental protection and intellectual property rights, but also face the dilemma of demonization and pan-politicization. Looking beyond the country, foreign-funded enterprises are enjoying super national treatment everywhere.
