土地制度是国家制度的基础,完善和健全的土地制度能促进经济、政治,乃至社会的发展。对于农村土地承包经营权是否可以抵押的探讨由来已久。2007年党的十七届三中全会的决定提出,加强农村土地承包经营权流转管理和服务,建立健全农村土地承包经营权市场,按照依法自愿有偿原则,允许农民以转包、出租、互换、转让、股份合作等形式流转土地承包经营权,发展多种形式的适度规模经营。报告再次将土地承包经营权的流转推到了学术争论的焦点,关于是否放开对农村土地承包经营权的抵押的争论也逐渐清晰。
