近现代刑罚目的理念的发展决定了合目的性是公诉权的本质属性。公诉权的合目的性决定有必要扩大和规范公诉裁量权。我国现行公诉裁量权制度存在诸多缺陷,应借鉴国外先进理念,确立和完善我国微罪不起诉、暂缓起诉和选择起诉制度,规范撤回起诉制度。
The development of modern concept of the purpose of the penalty determines that the objective property is the essential attribute of the public prosecution right. The purpose of public prosecution decided that it is necessary to expand and standardize the discretion of public prosecution. The existing system of discretion of public prosecution in our country has many flaws. We should learn from advanced foreign ideas and establish and improve our system of non-prosecution of minor crimes, suspension of prosecution and selection of prosecution system, and standard withdrawal of prosecution system.
