传统的英美法系国家对军事司法往往偏重战争适应性,对公正性关注不够。加拿大在1998年、2008年、2013年分别多次对《国防法》进行修订,奠定了其现行的军事司法制度基础,较好地兼顾了二者的平衡,在解决这个两难的问题上走到了英美法系国家前列。特别是在军事检察制度方面,立法者以修订《国防法》为契机,多角度着手对军事检察体制进行调整与完善,力求使其摆脱军事指挥权的控制和干涉,从而将公平、正义价值提升到与纪律、秩序相同的高度,不断增强军事检察制度的独立性。
