法庭审问是典型的以机构目的为导向的话语在整个审问中充满问答的互动。法庭话语的机构目的就是寻求正义,惩罚犯罪,以此来达到影响外部世界。这种目的也会影响话语参与者的言语行为:参与者必须扮演特定的角色,遵循界定好的规则,使用因袭的语言。本文从语言的视角来研究法官在庭审中的角色,通过研究发现:在审判的不同阶段,法官会采取不同的角色,不同的角色有不同的语言表现形式,法官的这些机构角色是其话语形式的前提,而其话语形式又加强了其机构角色和权力地位。
Court interrogation is a typical case-driven discourse full of question-and-answer interactions throughout the interrogation. The purpose of the courtroom discourse is to seek justice and punish crime in order to influence the outside world. This purpose also affects the verbal behavior of discourse participants: the participants must play a specific role, follow well-defined rules and use the language of succession. This paper studies the judge’s role in the courtroom from the perspective of language. Through the research, it is found that judges play different roles in different stages of trial, and different roles have different linguistic expressions. Judges’ roles in these institutions are their discourse forms Of the premise, and its discourse form has strengthened its institutional role and power status.
