土地使用权转让合同属于债权合同,而土地使用权的转移属于物权的变动,签订土地使用权转让合同,并不当然使土地使用权发生物权的变动,只有在办理登记之后土地使用权发生转移,才产生物权变动的效力。文章对土地使用权转让合同与物权变动进行分析,认为违反《城市房地产管理法》的行为,对土地使用权转让合同的效力没有影响,也不会对土地使用权的变动产生影响。
The transfer of land use right contract belongs to the debt contract, and the transfer of land use right belongs to the change of real right. Signing the contract of transferring land use right does not of course make the change of real right of the land use right. Only after the registration of land use right Transfer, it produces the effect of changes in property rights. The article analyzes the contract of the transfer of land use rights and the change of real right. It considers that the violation of the “Urban Real Estate Management Law” has no effect on the validity of the contract of transfer of land use rights and will not affect the change of land use rights.
