国际海洋法法庭是与国际法院、国际刑事法院等并列的国际司法机构,它是根据1982年通过、1994年生效的联合国海洋法公约(以下简称《公约》)设立的专门处理海洋法争端的常设性国际司法机构。虽然国际海洋法法庭(以下简称海洋法庭)自1996年8月在德国汉堡成立至今,登记处理的案件只有13个,但与许多国际司法机构早期的运行轨迹相比,发展的势头尚可。海洋法庭既在诸多方面学习了国际法院和其他国际司法机构的经验,也在法官的更为广泛的代表性、当事人的范围、管辖权的强制性和法庭的工作效率等方面,与国际法院相比又有了新的发展。
The International Tribunal for the Law of the Sea is an international judicial institution accredited to the International Court of Justice and the International Criminal Court. It is a permanent judicial body set up under the United Nations Convention on the Law of the Sea (“the Convention”), adopted in 1982 and entered into force in 1994, International judicial institution. Although the International Tribunal for the Law of the Sea (hereinafter referred to as the “Tribunal”) has registered and handled only 13 cases since the establishment in Hamburg, Germany in August 1996, its momentum of development is still comparable with that of many international judicial bodies in the early days. The Tribunal not only learned in many ways the experience of the International Court of Justice and other international judicial institutions, but also with the more extensive representation of judges, the scope of parties, the compulsion of jurisdiction and the efficiency of the Tribunal, Than the new development.
