规范性文件分为立法性文件和非立法性文件,后者主要指行政规范性文件,其法律效力低于立法性文件。近年来,各地各级行政机关制定的行政规范性文件不仅数量多,而且在内容和程序上多有不合法、不合理之处,极大地损害了地方政府的公信力和权威性。只有依法行政、简政放权,转变政府职能,构建服务型政府,才是强化行政规范性文件中法治精神的根本途径,其中各级领导干部在推进依法行政、依法治国的进程中发挥着重要作用。
