截至2010年,我国已有十几个省市制定了实施《中华人民共和国民办教育促进法》的地方性法规。地方立法本身说明民办教育事业正受到各级政府越来越多的重视。然而,仔细分析其中的内容后,可以发现,对民办教育发展过程中的一些重大问题仍然未能得到切实有效的解决。这具体表现在:民办学校的身份归属,仍然模糊不清;出台的扶持政策,力度有限;政府给予民办学校的优惠待遇,比较有限;法律赋予民办学校的办学自主权,落实不够;民办学校的退出机制,程序上有明显缺陷。
As of 2010, more than a dozen provinces and cities in our country have formulated local laws and regulations that implement the Law of the People’s Republic of China on Promoting Private Education. Local legislation itself shows that private education is receiving more and more attention from all levels of government. However, after careful analysis of the contents, we can find that some major problems in the development of private education are still not effectively solved. This is manifested in the following aspects: the ownership of private schools remains vague and unclear; the supportive policies promulgated are of limited intensity; the preferential treatment given by the government to private schools is relatively limited; the autonomy given by law to private schools is not implemented enough; Withdrawal mechanism, the procedure has obvious flaws.
