随着人们对刑事和解的不断研究和实践,人们越来越强调社区在和解程序中的参与。但在实践中,社区的参与并不一定是常态。笔者认为,社区进入到刑事和解程序并不是偶然,其背后有利益相关和市民自治理论基础为支撑。同时,社区加入刑事和解给这一纠纷解决机制带来了许多有利因素,例如信息优势、心理支持、社区规范的强化以及促进加害人复归社会。
As people continue to study and practice criminal reconciliation, people increasingly emphasize community participation in reconciliation proceedings. In practice, however, community participation is not always the norm. The author believes that the community into the criminal reconciliation process is not by accident, behind the basis of interests and autonomy theory of civil support. At the same time, the community’s participation in criminal reconciliation has brought many favorable factors to this dispute resolution mechanism, such as information superiority, psychological support, strengthening of community norms and promotion of reintegration of perpetrators into society.
