非依据法律行为取得房屋所有权的主体和物业使用人应作为物业管理法律关系规范的对象。业主大会不具备独立的民事主体地位,仅在法律有特别规定的情况下有应诉资格。对于可能导致部分专门所有权严重损害的情形,可考虑规定相关业主一致同意的一致表决原则。管理规约的适用范围应及于物业使用人,临时管理规约与前期物业服务合同的效力宜保持一致。
