在我国国有土地所有权和使用权分离的经济体制下,已出现多宗建设用地使用权到期的案例,然而由于政府与业主的利益诉求难以平衡、房地产本身的性质以及法律顶层设计的缺陷等原因,导致建设用地使用权续期问题至今仍不能有效地解决。本文就此进行分析,并提出解决建议。
However, due to the balance of interest demands between the government and the owners, the nature of the real estate itself and the defects in the design of the law at the top, some cases of the expiration of the right to use the construction land have appeared under the economic system with the separation of ownership and usufruct of the state-owned land in our country. As a result, the issue of the renewal of the right to use construction land has not yet been effectively solved. This article analyzes this and proposes solutions.
