当年《一个馒头引发的血案》视频短片在网络上传播,引起了人们对著作权合理使用与侵权的争论。如今,已是时隔十年,很多人对这样一个在推动我国《著作权法》进一步完善过程中具有里程碑意义的案例或许已经淡忘。但尚存遗憾的是,从目前来看,我国《著作权法》还未对其最脆弱和最模糊的部分——合理使用制度,作出强有力的修正,尤其数字信息时代下,合理使用的边界不清,限制不明,暧昧愈加显现。本文将再次回顾《馒头血案》这一经典案例,希望能引发受众对著作权及其合理使用制度新的思考。
