近年来我国各地推行的“宅基地置换”和“集体建设用地流转制度试点”等集体建设用地置换政策性实践,是在我国土地法律制度出现不足或问题时,中央和地方进行实践探索的一项重要的非正式法律渊源,其探索的一些成果,如土地指标化管理制度、集体建设土地上市交易制度、指标控制法律制度和不同性质建设用地在置换中产生的制度难题及其解决思路等等,都将深远地影响着我国未来集体建设用地法律制度的生长和发展。也对我国未来的《土地管理法》的修改和完善奠定了基础。在这个意义上而言,城乡建设用地置换的政策性实践是我国集体土地法律制度宝贵的“资源”。
