伴随着地球生态环境的恶化,全球性环境问题引起了人们的高度重视,为了应对其带来的危害,各国开始纷纷倡导低碳经济,环保节能等。共同但有区别原则的概念在此背景下应运而生。共同但有区别的责任原则应用于国际环境法中成效良好,具有科学性和合理性。本文首先通过回顾共同但有区别责任原则概念的演变,再结合形势探讨了共同但有区别责任原则存在的主要问题,最后提出一些建设性的建议,以期推动该原则的改善。 With the worsening of the earth’s ecological environment, global environmental issues have drawn great attention from the people. In order to deal with the harms brought about by them, various countries have started to advocate a low-carbon economy, environmental protection and energy saving. The concept of the principle of common but differentiated came into being in this context. The principle of common but differentiated responsibilities applies well to international environmental law and is scientific and reasonable. Firstly, by reviewing the evolution of the concept of common but differentiated responsibilities, this paper explores the main problems existing in the principle of common but differentiated responsibilities, and finally puts forward some constructive suggestions to promote the improvement of the principle.
