法院公信力是社会大众对司法制度以及司法裁判的信任程度。基于公信力衡量标准的多视觉思维的复杂性,要树立一种单一的衡量标准是不可能做到的,也是违反法律运行的基本原理。法院公信力的衡量应当建立在以法院审判执行办案为核心的日常工作的精细化管理体系建设上,将主观认识上的法院公信力感受转化为具体的工作常态指标。在审判实践中,要抓住法院管理中能够掌控的主要措施,筛选确立关键性工作质效指标,将司法判断力、裁判说服力、司法自律力、强制执行力等通过案件审判管理过程中的相应的指标予以评价和提升。其有效途径包括以事实的查明、实体法的适用、理性的判断三位一体来提升司法判断力;以正当的司法程序来提升裁判说服力;以制度保障和舆论监督来提升司法自律力;以执行工作长效机制建设来提升司法强制力。
Court credibility is the public’s trust in the judicial system and judicial decisions. The complexity of multi-visual thinking based on the standard of credibility measurement can not be achieved by setting a single standard of measurement. It is also a violation of the basic principles of legal operation. The measurement of the credibility of the court should be based on the fine management system of daily work centered on the trial of the court for execution and handling, and transform the perception of the court’s credibility in the subjective cognition into a specific index of normal work. In the trial practice, we should seize the main measures that can be controlled in the court management, screen and establish the index of the quality of the key work, and pass the judicial judgment, referee’s persuasiveness, judicial self-discipline and enforcement power through the case trial management process Appropriate indicators to be evaluated and improved. The effective ways include ascertaining the facts, the application of the substantive law and the judgments of rationality to enhance judicial judgment; improving judicial persuasion through proper judicial procedure; enhancing the judicial self-regulatory power by system guarantee and public opinion supervision; Work long-term mechanism to enhance judicial coercion.
