鉴于我国目前牵扯法官偏离公正立场的力量不仅来自法院外部 ,而且也来自法院内部 ,需要对法官制度的国际化发展趋势进行评价。近年来 ,国际社会对法官资格的取保更加严格 ,法官独立原则得到进一步强化 ,法官的属审判权不断扩大 ,对法官的管理更加专门化 ,失职法官由专门机构进行惩戒。借鉴国际作法 ,我国法制制度改革的重点应是严格法官资格的选任 ,为法官提供良好的职能保障 ,改变法院内部的行政化管理模式 ,通过建立现代化法官任职制度、晋升制度、考核制度、惩戒制度和法官独立审判制度来实现司法公正和司法效益的价值目标。 In view of the fact that the power of judges in our country deviating from the just position is not only from the outside of the court but also from the inside of the court, it is necessary to evaluate the trend of the internationalization of the judge system. In recent years, the international community has tightened the qualification of judges, the principle of judges ’independence has been further strengthened, the judges’ jurisdictions have been continuously expanded, the administration of judges has become more specialized, and the non-performing judges have been disciplined by specialized agencies. In reference to international practices, the reform of China’s legal system should focus on the selection of qualified judges, providing judges with good functional guarantees, changing the administrative management model within the courts, establishing a modern system of judges’ appointment, promotion of the system, examination and punishment systems And judges judge the system independently to realize the value goal of judicial justice and judicial benefit.
