自2004年以来,一些国内外的专家和学者在徐显明教授的带领下,对亚太地区和欧洲的依照联合国“巴黎原则”设立的国家人权机构进行了细致的考察,以期从中探索一个适合中国国情的模式。首先,作为一个联合国安理会常任理事国,中国担负着依据联合国条约履行国际法律义务的责任。一些核心条约机构建议中国设立国家人权机构的号召值得我们注意,并采取措施予以积极的回应。在此基础上,考虑设立国家人权机构的过程中,亚太地区其他国家的经验和教训值得我们借鉴。最后特别需要强调的是,国家人权机构模式只是对现有人权保护机制的一个有益的补充,将会为人权的促进和保护事业带来新机。
Since 2004, under the leadership of Professor Xu Xianming, some experts and scholars at home and abroad have conducted a careful study of the national human rights institutions established in accordance with the “Principles of the United Nations” in the Asia Pacific region and Europe with a view to exploring a suitable China’s national conditions. First of all, as a permanent member of the UN Security Council, China is responsible for fulfilling its international legal obligations under the UN Treaty. The call by some core treaty bodies to suggest that China establish a national human rights institution deserves our attention and measures should be taken to respond positively. On this basis, we should learn from the experience and lessons learned from other countries in the Asia-Pacific region in considering the process of setting up a national human rights institution. Finally, it is particularly important to emphasize that the NHRI model is only a useful complement to the existing human rights protection mechanism and will provide new opportunities for the promotion and protection of human rights.
