本文以2003年生效的国际民用航空新“经济宪法”《蒙特利尔公约》为视角,对我国《民用航空法》所规定的民用航空承运人责任制度进行了全面的探讨,对比分析二者在旅客人身伤害、旅客延误、行李及货物毁灭、遗失、损坏或者延误产生损失时的归责原则、责任限额、责任减免、限额适用限制以及运输凭证等方面的差别,分析其原因和历史承继关系,比较各自在有关制度上的优劣,以期在今后对我国《民用航空法》进行修订时,尽量做到与国际接轨,以适应国际民用航空产业和全球经济社会一体化的需求。
From the perspective of the new “International Constitution of the People’s Republic of China” and the “Montreal Convention” that took effect in 2003, this paper discusses the responsibility system of civil air carriers under the Civil Aviation Law of the People’s Republic of China Passenger personal injury, passenger delays, the principle of liability at the time of the destruction, loss, damage or delay of baggage and cargo, the limitation of liability, the reduction of liability, the limitation of application of quotas and the transport documents, and analyzes the causes and the historical inheritance, Compare their respective advantages and disadvantages in the relevant systems, with a view to revising China’s “Civil Aviation Law” in the future to try to be in line with international standards so as to meet the needs of the international civil aviation industry and the global economic and social integration.
