司法考试代表“法条主义”和法律职业技能的应试教育-学习模式,它遮蔽了法学通识教育和人文素质培养的维度、同时司法考试能力也不代表司法实务能力。反思、反省现行司法考试对法学教育的负面影响,或可察觉到法学教育的本质与目的之类的大问题上的利弊得失。
The judicial examination represents the exam-oriented education-learning model of “legalism” and legal occupational skills. It covers the dimensions of law general education and humanistic quality cultivation. At the same time, the judicial examination ability does not represent the judicial practical ability. Reflect on and reflect on the negative impact of the current judicial examination on legal education or the pros and cons on major issues such as the nature and purpose of legal education.
