随着我国房地产经济的发展和住房制度改革的不断深人,商品房这种新型的特殊商品在居民消费中的地位日渐凸显,这就使得商品房的消费者权益保护成为了一个热点问题。由于商品房的交易安全直接关系到公民的基本生存权利,与居民生活密切相关,故理应将其纳人《消费者保护法》的范畴,引入惩罚性赔偿机制,在立法与司法上对在市场地位中处于劣势一方的消费者进行倾斜保护。
