诊所法律教育是高校法律援助的重要组成部分,对我国法律援助事业的发展起到了巨大的作用。但是大学生在开展法律援助的过程中,他们的身份问题一直存在较大争议,一方面他们参与办案很难得到司法机关和当事人的认可,同时他们拥有的权利也远不及律师,这严重阻碍了诊所法律教育的推进。立足我国现实的情况,借鉴美国的成熟经验,,明确诊所学生参与法律援助的身份和责任,推动我国诊所法律教育的发展。
Clinic legal education is an important part of legal aid in colleges and universities and has played a huge role in the development of legal aid in our country. However, in the process of legal aid, undergraduates have been facing a lot of controversy over their identity issues. On the one hand, they are hard-pressed to get approval from the judiciary and parties and they also have far fewer rights than lawyers, which seriously hinders the clinic Legal education promotion.
