国际私法并非纯粹的中立性规定,其本身即具有价值判断的意义;国际私法的制订和适用均须受到宪法基本权利的约束;德国国际私法理论和私法实践均已认可基本权利对国际私法的影响力;基本权利通过两种途径影响国际私法,其一是国际私法规范本身要符合基本权利的规定,其二是宪法基本权利构成对《民法施行法》第6条所规定之公共秩序的具体内容,可以据此排除外国法在具体案件中的适用;在此过程中不适用公共秩序保留制度中的关联性原则和重大性原则。
Private international law is not a mere neutrality. It has the value of value judgments. The formulation and application of private international law must be bound by the basic constitutional rights. Both German private international law and private law practice have recognized the impact of fundamental rights on private international law The basic rights affect private international law in two ways. The first is that the norms of private international law are in conformity with the provisions of basic rights. The second is that constitutional fundamental rights constitute the specific contents of the public order stipulated in Article 6 of the Law on Enforcement of Civil Law , So that the application of foreign law in specific cases can be ruled out. In this process, the principle of relevance and the principle of materiality in the reservation system of public order are not applicable.
