凌迟刑是中国古代封建社会最残酷的一种死刑,其特点是在行刑时零刀碎割,故意延长受刑者的死亡时间,加重其受刑时的痛苦。本文通过对凌迟刑起源、发展与废止历史进程的全面总结和研究,针对学术界对于凌迟刑入律时代的不同看法,提出了凌迟刑入律在宋代的观点,以期对中国刑罚史研究有所裨益。
Ling Lingxian is the most brutal death penalty in ancient Chinese feudal society. It is characterized by zero knife and knife cut, intentionally prolonging the death of the victim and aggravating the suffering during execution. This article, through a comprehensive summary and research on the origin, development and abolition of the historical process of Ling-ling punishment, aims at the different views of academia on the Ling-ling-criminal law age and puts forward the view that Ling-ling punishment should be punished in the Song Dynasty with a view to the study of Chinese criminal history benefit.
