行政承诺作为行政机关履行职责的一种新的方式近年来在行政管理中大量出现,这对于提高行政效率、维护相对人的合法权益都具有积极的意义。但由于行政承诺自身具有的特殊性,这也对行政机关做出承诺提出了很高的要求。现阶段我国行政承诺的实践还存在一系列的问题。如何规范行政承诺、使行政机关“言而有信”、如何使相对人的合法权益受到损害时得到应有的救济,都是值得我们探究的。 Administrative commitment as a new way for executive agencies to perform their duties has emerged in large numbers in the administration in recent years. This is of positive significance for improving administrative efficiency and safeguarding the legitimate rights and interests of the relative. However, due to the particularity of the administrative commitment itself, this also places high demands on the commitment made by the executive authorities. At present, there are still a series of problems in the practice of China’s administrative commitment. How to standardize the administrative commitment so that the executive authorities “have a word and believe ” and how to get the due relief when the relative rights and interests of the relatives are harmed are all worth exploring.
