通过分析文学艺术作品的叙事,发现其中的法律制度、制度变迁等法律主题的方法,是法律社会学研究由来已久的重要方法。本文通过对两部法制电影《秋菊打官司》和《十二公民》的叙事进行分析,对叙事中所隐喻的社会结构、社会变迁和社会整合等问题进行深入挖掘,从而试图从影片叙事的变化中,发现二十年来中国社会结构的变迁,以及在这一变迁过程基础上中国法治嬗变的过程:在《秋菊打官司》的时代,中国社会尚处于社会分层并不明显的熟人社会阶段,现代法治的理念与实践尚不能与熟人社会的社会控制和集体意识相融合;二十年后,在《十二公民》所处的时代,社会出现了明显的阶层分化,阶层间的利益和价值对立甚至冲突长期存在;此时,现代法治的规则理念和实践作为能够重新建立秩序、维系社会整合、社会重新结构化的基本要素,成为社会各阶层的共识,从而使现代法治的理念和实践在当今的社会结构中,发展为新的社会控制和集体意识。
