编辑同志:2009年3月,我与某房地产开发公司签订了一份《商品房买卖合同》,该合同对房屋的价格、付款方式等进行了约定。在交房时间条款中我们双方约定:除不可抗力因素以外,开发商应于2010年元月底交房,如逾期60日未交房,买方有权退房,并要求开发商按合同总价的4%支付违约金。合同签订后,我一次性付清了所有房款,但是直到今天开发商也没有将房屋交付给我。我找到开发商交涉,开发商称,由于施工过程中遇到暴雨,致使无法按工程进度施工,应属不可抗力原因造成的,因此,可以延期交房。请问开发商的说法正确吗?
