编者按:权利可视为划定行为界限、构建伦理法律制度、解释历史发展的一种方法,而权利的概念化、体系化、制度化以及社会后果,又依赖逻辑学、伦理学、社会学、心理学、经济学、法学等不同知识体系的方法予以阐释或论证、描述或分析。20世纪90年代,继权利本位、人权理想、法治国家的讨论后,学者们宣布中国“开始迈入权利时代”。权利时代,既要实现在横向关系上的权利界定及其救济,更要完成权利方法对权力机制的塑造,让权力实践除受制于自身逻辑外还受制于权利关系,即要将权利作为达成整个社会秩序的核心方法。这当然离不开权利形成、配置、实践、反馈的具体方法的繁荣。为此,本刊第三届青年公法论坛(2013年10月12—13日)以“作为方法的权利和权利的方法 ”为题。

To this end, the third issue of Young Public Law Forum (October 12-13, 2013) adopts the “method of rights and rights as a method” as its title.
