在国际空运迅猛发展、反恐怖主义时代等背景下空难发生频率提高、损失更为严重、发生原因愈加复杂。芝加哥公约对国际空难的调查主导权有粗略的规定,但对不同失事原因及技术、政治等诸多因素没有相应细致的针对性规定。本文拟就依据《国际民航公约》及其附件13《航空器事故和事故征候调查》对国际空难事故调查主导权的确定进行探讨。
In the context of the rapid development of international air transport and the anti-terrorism era, the frequency of air-raid accidents has risen and the losses have become even more serious. The reasons for this are even more complicated. The Chicago Convention has a rough guideline on the dominance of investigations of international air crashes, but there are no correspondingly detailed provisions on the causes of different incidents and on various factors such as technology and politics. This article intends to discuss the determination of the dominance of the investigation of an international plane accident based on the “Convention on International Civil Aviation” and its Annex 13 “Aircraft Accident and Incident Investigation”.
