在社会主义市场经济体制下,人力资源的市场化配置愈来愈明显,相应地人事档案管理应与时俱进,但是现行的人事管理法律制度框架已明显不适应新形势、新要求。本文通过分析我国人事档案管理现行的法律依据所存在的主要问题,认为要理顺人事档案管理,必须整合现有的法律依据,从宏观出发,进行顶层设计。鉴于全面修改《档案法》,在《档案法》设立分则就人事档案管理做出专门规定的时机尚不成熟,提出了尽快出台《人事档案管理条例》的构想,并将拟出台的《人事档案管理条例》应急需解决的主要问题进行了探讨。
Under the socialist market economic system, the market allocation of human resources becomes more and more obvious. Accordingly, the management of personnel files should keep pace with the times. However, the current legal framework for personnel management has obviously failed to meet the requirements of the new situation and new requirements. By analyzing the main problems existing in current legal basis of personnel file management in our country, this paper argues that to rationalize the management of personnel files, the existing legal basis must be integrated and the top-level design must proceed from the macro perspective. In view of the comprehensive revision of the “Archives Law”, it is still not yet ripe to set up special provisions in the “Archives Law” on the management of personnel files. The idea of “Regulations on the Management of Personnel Archives” is put forward as soon as possible and the “ Archives Management Regulations ”emergency to be resolved the main issues were discussed.
