《环境法价值论》作者系北京大学法学博士,北京金融证券中心主任,中共北京市委政法系统特邀监督员。本书主要是讨论环境法的价值问题,这是我国目前环境法学的重点任务。对环境法价值的讨论,同时也是对传统法学价值论的反思。传统法学的价值论是以保护人的权利为核心价值论,这种价值论是适应人类社会内部成员处理关系和分配利益的现实的。但是,环境法的研究对象与传统法学不同,它不仅研究人与人的关系,而且更强调人与自然的关系。因此我们需要在环境法架构下对社会系统进行扩充,即将人的系统扩展为自然的系统,在这种思路下,法学的价值就展开到了自然系统之中,这就是生态主义自然观的基本思想。这种生态哲学认为,人类属于自然的一部分,是生命共同体中的一员,要求人类实行尊重大自然的原则,应该设法和自然和谐相处,而不是单纯地让自然只满足我们的需要,更不是征服和破坏自然,应该尊重其他生命形式的价值和延续性,维护大自然的稳定性、完整性和多样性。同时,自然环境是属于全球的,更属于人类共同的未来,因此,我们在谋求自己的利益时要考虑到对别人、对后代的责任。
The author of “Environmental Law Value Theory” is a doctor of law of Peking University, director of Beijing Financial Securities Center, and invited supervisor of Beijing Municipal Party Committee and CPPCC. This book mainly discusses the value of environmental law, which is the key task of environmental law in our country. The discussion of the value of environmental law is also a reflection of the traditional value of law. The value theory of traditional jurisprudence takes the protection of human rights as the core value theory, which adapts to the reality that the internal members of human society handle relations and distribute benefits. However, unlike the traditional jurisprudence, the object of study of environmental law is not only to study the relationship between people, but also to emphasize the relationship between man and nature. Therefore, under the framework of environmental law, we need to expand the social system, that is, expand the human system to a natural system. Under this kind of thinking, the value of jurisprudence is expanded into the natural system. This is the basic idea of the ecologicalist concept of nature . This ecological philosophy holds that mankind is a part of nature and a member of the community of life. It requires mankind to practice the principle of respecting nature and should try to live in harmony with nature instead of simply letting nature meet only our needs, not to mention To conquer and destroy nature, we should respect the values and continuity of other life forms and safeguard the stability, integrity and diversity of nature. At the same time, the natural environment belongs to the whole world and belongs to the common future of mankind. Therefore, we must consider our responsibility to others and to future generations when seeking our own interests.
