民间法秩序是地方民众围绕着财富分配所形成的总体性的竞争与合作秩序。作为“总体社会事实”的民间法秩序,其实更多地是一种理解地方社会的视角,不是经验层面所有社会现象的简单叠加。而解读民间法秩序,可能会遇到纠纷的发生学机制、通过走进“他者”的精神世界来阅读法意识、民间法秩序中的国家因素等几个层面的方法论问题。 The order of folk law is a general order of competition and cooperation formed by local people around the distribution of wealth. In fact, the order of folk law, which is the “general social fact,” is more of an understanding of the perspective of local society than a simple overlay of all social phenomena at the empirical level. However, the interpretation of civil law order may encounter the occurrence of dispute mechanism, through into the spiritual world of “others ” to read the consciousness of law, national factors in civil law order and other aspects of the methodology.
