1999年元月,朱某等九人(申诉方)因终止劳动合同争议申诉到某市劳动争议仲裁委员会。朱某等九人原系某设备厂职工,1996年该厂与某外国公司合资,朱某等九人被派到合资公司,合资公司与其签订了为期2年的劳动合同(1997年1月1日至1998年12月31日)。1998年9月合资公司召开员工大会,宣布合资公司成为独资公司(被诉方)。朱某等九人的劳动合同未作变更,独资公司与其继续履行原劳动合同。1998年11月份,独资公司提前一个月书面通知朱某等九人:劳动合同期满,双方不再续签,终止劳动关系。合同终止
