当前我国经济快速发展,法律制度也逐渐健全起来,通过劳动合同,使得劳动者与用人单位双方的权利义务得到明确规定,近些年,劳动合同的纠纷频繁发生。在实践工作中,用人单位通常订立额度比较高的违约金来对劳动者的行为进行限制,避免其随意解除劳动合同,而由此出现的劳动合同违约金问题也日渐增多。当前我国的《劳动合同法》已经明确规定了关于劳动合同违约金的问题,从而更好地约束和限制劳动者与企业,保证两方的经济以及合法权益得到维护。本文就劳动合同法违约金制度的应用进行简要的分析与阐述。
At present, China’s economy is developing rapidly and the legal system is gradually being perfected. Through labor contracts, the rights and obligations of both workers and employers are clearly stipulated. In recent years, disputes over labor contracts occur frequently. In practical work, employers usually set a relatively high liquidated damages to limit the behavior of workers and avoid their arbitrary dissolution of labor contracts, and the resulting liquidated damages of labor contracts are also increasing day by day. At present, China’s “Labor Contract Law” has clearly stipulated the issue of liquidated damages in labor contracts, so as to better restrain and restrict laborers and enterprises and ensure that both the economy and the legitimate rights and interests are maintained. This article briefly analyzes and expounds the application of the system of liquidated damages in labor contract law.
