联防联治是实现我国大气环境污染良治的必然要求。鉴于大气污染问题具有整体性、流动性和复杂性,政府的防治行动需要突破传统以行政辖区划分为标准的“各自为战”和“只抓重点”的部分区域间“协同防控”。新修《大气污染防治法》的亮点之一,是加强了对“联防联治”法律机制的规定,深入探究,“联防联治”法律机制的有效落实,需强调同行政辖区内各级政府部门间的“纵向联防联治”和不同行政辖区内同级政府部门间“横向联防联治”的立法指向,明确共担责任及利益协调等原则,确保“联防联治”的统一调控和良性合作;此外,应细化大气污染联防联治制度设计,制定“区域的划定标准”并以此为基础,对涉及防治主体及其间的权力配置和监督予以规范。
