为进一步保护欧盟成员国消费者的利益,近年出台的《欧盟不公平商业行为指令》采取总括式立法,统一对各类显性或隐性的不公平商业行为进行了规范。该指令不仅明确制定了判断不公平商业行为的标准,列举了31种典型的不公平商业行为,还把不公平商业行为分为误导性商业行为和侵犯性商业行为两大类,对经营者课以更重的职业注意义务,对处于弱势地位的消费者的合理期望提供了全面的法律救济。学习这种总括式兼列举式的立法模式,可弥补我国单独立法如《消费者权益保护法》、《广告法》、《产品质量法》以及《反不正当竞争法》等不能涵盖全面的缺陷,更有利于全方位保护消费者利益。
In order to further protect the interests of consumers in member countries of the European Union, the EU Directive on Unfair Commercial Practices issued in recent years adopts the omnibus legislation and unifies the various types of explicit or implicit unfair commercial practices. The Directive not only clearly sets standards for judging unfair business practices, cites 31 typical unfair business practices, but also classifies unfair business practices into two categories: misleading business practices and offensive business practices, With a heavier professional duty of care, comprehensive legal remedies are provided to the reasonable expectations of disadvantaged consumers. Learning this kind of omnibus and enumerated legislative model can make up for the comprehensive defects that can not be covered in our country’s separate legislation such as “Consumer Protection Law”, “Advertising Law”, “Product Quality Law” and “Anti-Unfair Competition Law” , More conducive to the full protection of consumer interests.
