尽管《土地管理法》没有规定工业用地出让需要采取招标、拍卖、挂牌的公开竞价方式,也没有规定工业用地最低出让价,但国土资源部却从提倡到强制对工业用地出让价格进行管制。不过由于现有土地管理制度本身的问题,加之招商引资压力,地方政府有反管制的冲动,工业用地出让价格管制体系在不断被复杂化的同时却成效不大。要解决工业用地出让价格管制失效的问题,需要改变指标式管理模式,打破城市建设用地市场的分割与垄断。
Although the Land Administration Law does not require the bidding, auctioning and listing of open bidding methods for the transfer of industrial land, nor does it stipulate the minimum selling price for industrial land, the Ministry of Land and Resources has, from the promotion of the government, forced the control of the price of industrial land transfer. However, due to the problems of the existing land management system itself, coupled with the pressure of investment attraction and the anti-regulatory impulse of local governments, the control system for the price of industrial land transfer is constantly being complicated while achieving little success. To solve the problem of invalidation of the control over the transfer price of industrial land, it is necessary to change the index-based management mode and break the division and monopoly of the urban construction land market.
