近年来,食品安全事故的频繁发生使食品安全越来越受到人们的重视。面对诸多的食品安全问题,建立快速有效的食品安全法律体系已迫在眉睫。食品召回制度作为建立食品安全体系的重要一环,有着举足轻重的地位,具有重要的理论研究价值。以《中华人民共和国食品安全法》为理论研究背景,以我国的食品召回法律制度为主线,提出该制度体系尚存在的不足,并以美国为例总结国外食品召回制度的特点,以此为借鉴,探讨如何使食品召回制度发挥其应有的作用。
In recent years, frequent occurrence of food safety accidents make food safety more and more people’s attention. In the face of many food safety problems, it is imminent to establish a fast and effective legal system of food safety. As an important part of the establishment of food safety system, food recall system plays an important role and has important theoretical research value. Taking the “Food Safety Law of the People’s Republic of China” as its theoretical research background and the legal system of food recall in China as its main line, this paper puts forward the insufficiency of this system and takes the United States as an example to summarize the characteristics of the foreign food recall system as a reference , To explore how to make the food recall system to play its due role.
