体育仲裁是我国《体育法》等体育法规确定的解决体育纠纷的基本方式,民间性是体育仲裁的基本属性。作为仲裁制度和体育制度的有机组成部分,体育仲裁制度的建立和完善需要从这两个制度获得理论和技术支撑,这两个制度本身的缺陷与失调会成为建立体育仲裁制度的障碍。民商事仲裁与行政仲裁的划分及不同立法模式,仲裁法实施中的行政化倾向以及现行行政主导型的竞技体育管理体制,均为民间性体育仲裁制度的建立设置了诸多障碍。体育仲裁制度的建立和实施需要这些基础制度的修改和完善。
Sports arbitration is the basic way to solve sports disputes as determined by the sports laws such as “Sports Law” in our country. Non-governmental nature is the basic attribute of sports arbitration. As an integral part of the arbitration system and the sports system, the establishment and improvement of the sports arbitration system need theoretical and technical support from these two systems. The defects and imbalances of these two systems will become barriers to the establishment of the sports arbitration system. The division of civil and commercial arbitration and administrative arbitration as well as the different legislative modes, the tendency of administrativeization in the implementation of Arbitration Law and the current executive-led competitive sports management system all set many obstacles for the establishment of non-governmental sports arbitration system. The establishment and implementation of the sports arbitration system needs the revision and improvement of these basic systems.
