地方各级人大设立十年来,在依法实施监督权方面作了一些探索,取得了某些成效。然而,在依法行使“撤销职务”这一职权方面,一些地方人大常委会还实施得不够,基本还停留在纸面和口头上。究其原因,一是宪法和地方组织法对此规定太原则,在实际工作中很难操作和实施;二是对法律规定的这种较严厉的监督职权尚未作较多的、深层次的研讨,特别是对如何实际运用这一监督形式研讨得不够。故此,笔者特借本文,对“撤销职务”这一监督形式作一初探。一、关于“撤销职务”的法律、法规依据 (一) 法律依据地方组织法第39条第12款规定:人大常委会可以“在本级人民代表大会闭幕期间,决
