本文认为,工会组织运行存在福利导向、组织导向和权利导向等不同形式,派遣劳动者组织权的实现更多地要求以权利为导向。尊重派遣劳动者的自主选择权,以利益共同性原则确定派遣劳动者群体,以实际控制原则与契约主体原则共同确定雇主身份等措施,是实现以权利为导向的派遣劳动者组织权的基本制度保证。
This paper argues that there are different forms such as welfare orientation, organization orientation and rights orientation in the running of a trade union organization. The realization of dispatching the right of workers to organize more demands that the rights be oriented. Respecting the right of workers to choose their own discretion, determining the group of workers by the principle of common benefit, and determining the employer identity jointly by the principle of de facto control and the principle of deed of contract are the basic systems to realize the rights-oriented organization of sending workers Guarantee.
