自命为“黑客学校”的黑客网站等通过互联网传授黑客技术,为他人违法犯罪行为提供技术帮助和技术支持,已经成为亟待解决的刑法问题。此类传授黑客技术行为客观上催生了无数的正犯行为,从而在整体上的危害性远远大于正犯行为的危害性。应当考虑以传授犯罪方法罪打击传授黑客技术行为的可能性。但是网络犯罪的异化是一个共性的问题,传授犯罪方法罪的网络异化,体现在传授对象、传授行为以及犯罪主观要件等三个方面,对此传统刑法应当通过理论微调和扩张解释的方式进行积极回应。在扩张解释的边界之外,才应当考虑入罪化的必要性。
