修改后的《民事诉讼法》赋予了检察机关在民事案件审查中的调查核实权,有利于检察机关更好地践行其对民事诉讼活动的法律监督职责。调查核实权的行使,应当遵循基本的诉讼法理。规范检察机关调查核实权的行使有利于维护审判权的正当行使,有利于保障诉讼秩序正常进行,有利于防止检察权滥用。 The amended Civil Procedure Law gives the procuratorial organs the power of investigation and verification in the examination of civil cases, which is conducive to procuratorial organs to better perform their duties of legal supervision of civil litigation activities. The investigation and verification of the exercise of power, should follow the basic procedural jurisprudence. It is helpful for the procuratorial organs to investigate and verify the exercise of the right of investigation in favor of safeguarding the proper exercise of the judicial power, ensuring the normal operation of the lawsuit sequence and preventing the abuse of procuratorial power.
