为充分保障破产企业职工的合法权益,《破产法》吸收了劳动与社会保障部门和全国总工会等部门的意见,对职工权益作出了六方面保护特别规定。一是总则第六条规定：“人民法院审理破产案件,应当依法保障企业职工的合法权益,依法追究破产企业经营管理人员的法律责任。”
In order to fully protect the legitimate rights and interests of workers in bankrupt enterprises, the Bankruptcy Law absorbed the opinions of the labor and social security departments and the All-China Federation of Trade Unions and other departments and made special provisions on protection of employees’ rights and interests in six aspects. First, Article 6 of the General Provisions stipulates: “When handling a bankruptcy case, the people’s court shall protect the legitimate rights and interests of the employees of the enterprise according to law and hold the legal liability of the bankrupt enterprise manager in accordance with the law.”
