本文从我国对外经济发展现状及其发展前景的角度，指出我国传统国际司法协助理论，尤其是国际司法协助的概念与范围，已不能适应现阶段我国对外经济关系发展之需要，论证了在传统国际司法协助领域内纳入国际刑事司法协助的可行性与必要性，并进一步提出了国际司法协助的新概念与国际刑事司法协助的具体内容。
This article points out that the concept and scope of our country’s traditional theory of international judicial assistance, especially international judicial assistance, can no longer meet the needs of the development of our country’s foreign economic relations at this stage from the perspective of the current situation of our country’s foreign economic development and its development prospects. The possibility and necessity of including international criminal justice assistance in the area of mutual legal assistance and further elaborated the new concept of international judicial assistance and the specific content of international criminal justice assistance.
