随着中国由纯粹的资本输入国逐步同时成为资本输入与资本输出国,中国海外投资导致的环境问题也产生了。本文从母国的角度出发,在分析中国保护海外投资地环境的政治、经济和法律理由的基础上,针对中国规制海外投资地环境的法律现状和问题,从中国的国内法和国际法两个方面,尝试性地提出了中国海外投资地环境保护的法律构想。 With China gradually becoming a capital-importing and capital-exporting country from a purely capital-importing country, environmental problems caused by China’s overseas investment have arisen. Based on the analysis of the political, economic and legal reasons for China’s protection of the environment of overseas investment, from the perspective of home country, in view of the legal status quo and problems of China in regulating the environment of overseas investment, from the perspectives of domestic law and international law, Tentatively put forward the legal conception of environmental protection of overseas investment in China.
