随着世界经济的迅猛发展,全球对于化石能源的需求与日俱增,人类对于石油资源的勘探与开采早已从陆地转向海洋。石油开采活动越来越频繁、开采范围愈加拓展,其造成的油污损害的风险也在增加。加上海水本身流动性强的特质,海水中的污染物质会随着海洋的流动向其他海域扩散,极易对其他国家管辖范围内的海域造成跨界污染。本文立足于对墨西哥湾溢油事故的分析,从海上钻井平台的油污损害赔偿的责任主体入手,同时,依据现有国际法文件,对相关环境损害赔偿责任成立的基础进行梳理,以求对海上石油污染中的赔偿责任制度有较好把握。
With the rapid development of the world economy, the global demand for fossil energy is increasing day by day. The exploration and exploitation of petroleum resources by mankind have already been turned from land to sea. The oil exploitation activities are more and more frequent, the exploitation range expands further, and the risk of oil pollution damage increases. Coupled with the strong liquidity of seawater itself, pollutants in seawater will spread to other areas along with the flow of oceans and may easily cause cross-border pollution to other areas under the jurisdiction of other countries. Based on the analysis of the oil spill accident in the Gulf of Mexico, this paper starts with the liability principal of oil pollution damage compensation of offshore drilling platform. At the same time, based on the existing documents of international law, it sorts up the foundation of the liability of environmental damage compensation, Pollution in the liability system is better grasp.
