对一种权力的属性界定,应着眼于我国特定的国家权力结构配置及运作形态。在我国现行权力结构配置中,司法权的概念必然不同于西方国家。不同于三权分立的权力架构,我国不能采用模糊性“司法权”概念去界定具有司法属性的各种权力。在中国现实国情下,广义地将审判权、检察权定位于司法权,将审判机关、检察机关统称为司法机关具有现实适用性。然而将这一语境化的概念、命题、论断普适化和一般化,既没有必要也缺乏理论依据。
The definition of a property of power should focus on the configuration and operation of the specific state power structure in our country. In the current configuration of power structure in our country, the concept of judicial power must be different from Western countries. Different from the power structure in which the three rights are divided, our country can not adopt the concept of ambiguity “judicial power ” to define various powers with judicial attributes.
