个案急呈申请人范某系某造纸厂职工,因单位原因放假在家。2014年年末劳动合同期满时,双方不再续订劳动合同,单位向范某支付经济补偿,标准是以其按月领取的生活费标准来计算。范某对此有异议,认为应当按照当地的最低工资标准来计算。单位则认为,根据《劳动合同法》的规定,应该以范某终止合同前12个月的工资(生活费)标准来计算的,符合法律规定。范某无奈向当地的劳动人事争议仲裁委员会申请了仲裁。
