职务犯罪近年来在我国大有愈演愈烈之势,刑罚作为打击职务犯罪的最有力措施,也要讲求设置的合理性与有效性。针对职务犯罪人独特的心理特征,在刑罚设置时,建议扩大罚金刑的适用范围;增设资格刑;取消死刑,代之以无期徒刑附加巨额的罚金或剥夺相应的资格。
In recent years, job-related crimes have been greatly aggravated in our country. Penalties, as the most effective measure to combat job-related crimes, also emphasize the rationality and effectiveness of the set-up. In view of the unique psychological characteristics of duty criminals, it is suggested that the scope of application of fine penalties should be expanded when the penalties are set up; the qualification penalty should be increased; the death penalty should be abolished and replaced by a fine or deprived of appropriate qualifications.
